JUSTICE DINESH KUMAR SINGH ORAL ORDER 06-01-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 147,341,323,307,504 and 506 of the Indian Penal Code.

The prosecution case is that the accused persons were assaulting the son of the informant when the informant came to rescue then she was assaulted by the petitioner by iron rod causing grievous injury.

It is submitted by the learned counsel for the petitioner that for the occurrence of 7.6.2014 the fard-e-beyan was recorded on 10.6.2014 at Purnea when the informant was examined at Araria Primary Health Centre on 7.6.2014 itself which suggests skin deep marginal size injury though the opinion was reserved. The injury report is dated 30.6.2014 though supplementary injury

Patna High Court Cr.Misc. No.52100 of 2014 (2) dt.06-01-2015 2/2 report issued by the Medical Officer, Sadar Hospital, Araria on the same day suggest the injury to be grievous. The petitioner side also received injury. Statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent. Considering the delayed lodging of the case, let the above named petitioner be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Araria in connection with Araria (Bairgachhi) P.S. Case No. 265 of 2014 subject to the conditions as laid down under Section 438(2) Cr.P.C.
