Petitioner seeks bail in a case registered for the offences punishable under Sections 420, 406, 409, 467, 468, 471, 120B/34 of the Indian Penal Code.
Petitioner was Mukhiya at the time of alleged occurrence and it is alleged that he withdrew Rs. 24,000/- from the account of complainant after placing another lady in place of complainant. The complaint petition goes to show that aforesaid withdrawal was made in the year 2007 but complainant lodged the present case in the year 2013 and no explanation regarding the aforesaid delay has been given by her though she admitted in her complaint petition that she came to know about the alleged
Patna High Court Cr.Misc. No.39191 of 2016 (3) dt.17-11-2016 2/2 occurrence when the amended BPL list was published in the year 2007-08.
Submission on behalf of the petitioner is that the present case as well as several other cases of similar nature were lodged against the petitioner at the behest of present Mukhiya, who has inimical term with the petitioner. Petitioner is in jail custody since 10.08.2016 and the investigation against him appears to have already been completed.
Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Sub Divisional Judicial Magistrate, Araria in connection with Jokihat P.S. Case No. 284 of 2013.
