Mr.APP ====================================================== CORAM: HONOURABLE MR. JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 03-09-2020 Heard learned counsel for the petitioners and the State. Learned counsel for the petitioners submits that the same informant has filed Complaint case against these petitioners and in that view of the matter he explains the statement made in para. 3 of the petition as to no criminal antecedent of the petitioners.

Considering the explanation made on behalf of the petitioners with regard to Annexure-2, the Court is accepting the bonafide statement made in para.3 of the petition. The petitioners are apprehending their arrest in connection with Balia P.S. Case No. 300 of 2019 for the offence under Sections 341, 323, 498(A), 313/34 of the Indian Penal

Patna High Court CR. MISC. No.22505 of 2020(2) dt.03-09-2020 2/2 Code.

Learned counsel for the petitioners submits that the husband of the informant has already been granted anticipatory bail. In view of the above, the case of petitioner no.1 (motherin-law of the informant), petitioner no.2 (sister-in-law of the informant) and petitioner no.3 (brother in law of the informant) stands on better footing.

Considering the aforesaid, the petitioners named above, in the event of arrest or surrender before the court below within one month from today, are directed to be released on bail on furnishing bail bonds of Rs.25,000/- (Rupees twenty five thousand) each with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Begusarai in connection with Balia P.S. Case No. 300 of 2019 subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
