NILU AGRAWAL ORAL ORDER 13-12-2016 Heard learned counsel for the petitioner and the learned A.P.P. for the State.
Petitioner is languishing in judicial custody since 02.7.2016 in connection with Harsidhi P.S.Case No. 204 of 2016 registered for the offence punishable under Section 414 of the Indian Penal Code.
The prosecution case as lodged by the police personnel is that the petitioner and two others were caught by the villagers with three stolen motorcycles and they disclosed that one Chunnu Tiwari, who used to bring the stolen motorcycles for selling the same in market.
It has been submitted by the learned counsel for the
Patna High Court Cr.Misc. No.51641 of 2016 (2) dt.13-12-2016 2/2 petitioner that he has no criminal history and other two accused persons caught along with the petitioner, have since been granted the privilege of bail by a Co-ordinate Bench of this Court vide Cr. Misc. No. 44977 of 2016 dated 19.10.2016 on similar allegations. However, learned A.P.P. for the State submits that the petitioner is named in the First Information Report, hence, opposes the prayer for bail.
Be that as it may, since other two co-accused persons have since been granted the privilege of bail on similar allegation, let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Motihari in connection with Harsidhi P.S.Case No. 204 of 2016.
