The petitioners apprehend their arrest in a case registered for the offences punishable under Sections 315, 376, 420 of the Indian Penal Code.
Learned counsel for the petitioners seeks permission to withdraw the present anticipatory bail application with respect to petitioner No. 1.
Permission is accorded.
Learned counsel for the petitioners submits the petitioner is a person with clean antecedent and being wife of Bindeshwar Paswan has been falsely implicated in the present case, it is next submitted that the informant alleges that she is a divorcee aged about 27 years with two children and she fell in love with Bindeshwar
Patna High Court CR. MISC. No.21855 of 2023(2) dt.05-07-2023 2/2 Paswan, the husband of the petitioner on false pretext of marriage, he established physical relation and when she asked him to marry, he resiled.
Learned counsel for the petitioner next submits that the petitioner has been falsely implicated in the present case, it is further submitted that the husband of the petitioner is in judicial custody. Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioners.
Considering the submissions made by the learned counsel for the petitioners, the petitioners above-named, in the event of their arrest or surrender before the learned trial court within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 5,000/- (Rupees Five Thousand) each with two sureties of the like amount each to the satisfaction of the learned trial court where the case is pending/successor court in connection with Maniyari P.S. Case No. 241 of 2022 subject to the conditions as laid down under Section 438 (2) of the Cr.P.C.
