JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 18-04-2017 The petitioner seeks transfer of Sessions Trial No. 344 of 2014 from the Court of learned Second Additional Sessions Judge, Bagaha to any other Court of equivalent jurisdiction under the same judgeship of West Champaran at Bettiah. He seeks transfer on the ground that learned Additional Public Prosecutor, who is conducting case of the prosecution, is close to some persons, who are related to learned Second Additional Sessions Judge, Bagaha. It is also his allegation that the said relative generally meets the learned trial Judge in his Chambers.

The ground which has been taken for transfer of the case is not at all germane and cogent for exercise of power under

Section 407 of the Code of Criminal Procedure, 1973. I do not find any merit in this application. This application is, accordingly, dismissed.
