JUSTICE VINOD KUMAR SINHA ORAL ORDER 10-01-2019 This is an application for grant of anticipatory bail in connection with Narpatganj P.S. Case No. 395 of 2018, disclosing offences under Section 366-A of the Indian Penal Code.

Allegation against the petitioner is of kidnapping the minor daughter of the informant and further allegation as per statement recorded under Section 164 Cr.P.C. is of committing physical relation with the informant.

Submission of learned counsel for the petitioner is that the petitioner has falsely been implicated in this case and the informant was recovered on the same day in the evening and also there is 3 days delay in lodging the F.I.R. Heard learned A.P.P. also.

Having heard both sides, considering the above facts

Patna High Court Cr.Misc. No.78664 of 2018(2) dt.10-01-2019 2/2 and circumstances of the case, I am not inclined to grant anticipatory bail to the petitioner, let petitioner surrender before the court below and make prayer for regular bail, which will be considered on its own merit, without being prejudice by order of this Court.
