This is an application seeking restoration of Cr. Misc. No. 41109 of 2012 which stand dismissed for non-compliance of earlier peremptory order dated 10th December 2013.

It appears that earlier petitioner was directed to take fresh steps for notice vide order dated 20th August 2013 that too was complied with only after taking one more week time as is evident from subsequent order dated 27th September 2013 and lastly for more than a year for no reason order dated 10th December 2013 has not been complied with. In that view of the matter, there appears no reason to accept

Patna High Court Cr.Misc. No.50855 of 2014 (2) dt.07-01-2015 2/2 the prayer on behalf of the petitioners. Consequently, this application in connection with Complaint Case No. 38 C of 2012 pending before SubDivisional Judicial Magistrate, Masaurahi at Patna is hereby refused.
