Mr. Sri Nityanand ====================================================== CORAM: HONOURABLE MR. JUSTICE VINOD KUMAR SINHA ORAL ORDER 07-12-2018 The petitioner seeks bail in connection with Ara Town P.S.Case No. 376 of 2018 registered under Sections 379 and 411/34 of the Indian penal Code.

Allegation as per the FIR is theft of motorcycle and the same is recovered from the possession of the petitioner for which a separate case has been lodged.

Submission of learned counsel for the petitioner is that he purchased the motorcycle from co-accused without knowing the fact that it is stolen property and he has been granted bail in that case and petitioner is in custody in this case for more than four and half months.

Having heard both sides and in the facts and circumstances, as stated above, let the petitioner, abovenamed,

Patna High Court Cr.Misc. No.71808 of 2018(2) dt.07-12-2018 2/2 be released on bail upon furnishing bail bond of Rs. 25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the learned CJM, Ara, Bhojpur in connection with Ara Town P.S. Case No. 376 of 2018 with condition that one of the bailors shall be a local person having sufficient immoveable properties within the jurisdiction of the court concerned.
