The petitioners seek bail in connection with Chanpatia (Sirisiya O.P.) P.S. Case No. 340 of 2018 instituted for the offence under Section(s) 467/468/471/414 of the Indian Penal Code and Sections 30(a)/30(b)/30(c) of the Bihar Prohibition and Excise (Amendment) Act, 2018.
It is alleged that total 10 litres of illicit country made liquor and motorcycle has been recovered from possession of petitioner no.1. It is further alleged that total 30 litres of illicit country made liquor, 16 quintal of gur along with motorcycle has been recovered from house of petitioner no2 . Learned counsel for petitioners submits that
Patna High Court Cr.Misc. No.73106 of 2018(2) dt.10-12-2018 2/2 motorcycle recovered from house of petitioner no.1 and 2 belongs to them except one motorcycle as mentioned in para 10 of the bail petition.
Petitioner are in custody since 9.8.18 Considering the aforesaid, let the petitioners, above named, be released on bail on furnishing bail bond of Rs. 10,000/-(Ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Special Judge, Excise Act, West Champaran at Bettiah in connection with Chanpatia (Sirisiya O.P.) P.S. Case No. 340 of 2018, subject to the condition that both the bailers shall be the close relative of the petitioners.
