====================================================== CORAM: HONOURABLE MR. JUSTICE ANSUL ORAL ORDER 19-05-2026 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

2. The petitioner seeks bail in Duraunda P.S. Case No. 336 of 2024, registered for offences punishable under Sections 126(2), 115(2), 118(2), 117(2), 109, 352, 351(3) and 3(5) of the BNS.

3. The allegation is that the petitioner along with six persons assaulted the son of the informant.

4. Learned counsel for the petitioner submits that there is no specific allegation of assault against the petitioner. He further submits that the injuries have allegedly been caused by hard and blunt substance but there is sharp cut injury in the injury report.

5. Learned counsel for the informant as well as learned Additional Public Prosecutor for the State have vehemently opposed the prayer for bail of the petitioner. Learned counsel for the informant submits that at the end of the FIR there is allegation of assaulting and causing fracture on hand and leg and that the petitioner bears four antecedents.

6. That the injuries have been caused by hard and blunt substance and there is sharp cut injury in the medical report. This may suggest that the petitioner was not the assailant. Thus this Court is inclined to grant bail to the petitioner after framing of charge.

7. Let the petitioner, above named, be released on bail after framing of charge on furnishing bail bonds of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Addl. Chief Judicial Magistrate-VI, Siwan, in connection with Duraunda P.S. Case No. 336 of 2024.

8. It is made clear that any observation made herein is prima facie in nature and limited solely for the purpose of adjudication of the present bail application. Such observations shall not be construed as an expression on the merits of the case and shall not
