JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 09-08-2017 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner apprehends his arrest in connection with Sibaipatti P.S. Case No. 97 of 2016, registered under Sections 409 and 420 of the Indian Penal Code.

The accusation is that petitioner being the Headmaster of Primary School, Harsher, Sipbaipatti, withdraw Rs.5,56,000/- but the said amount has been misappropriated by the petitioner. Learned counsel for the petitioner submits that, in fact, the F.I.R. is lodged by the District Programme Officer, Muzaffarpur, who later on informed to the Senior Superintendent of Police, Muzaffarpur, about not completing the work by this petitioner but now the petitioner has completed the work and also

Patna High Court Cr.Misc. No.18325 of 2017 (5) dt.09-08-2017 informed to the District Programme Officer, Muzaffapru through letter dated 24.07.2017, which would appear from annexure 4 to the supplementary affidavit.

Considering the aforesaid submissions, let the above named petitioner be released on bail, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate-cum-SubJudge-IX, Muzaffapur, in connection with Sibaipatti P.S. Case No. 97 of 2016, subject to the condition as laid down under Section 438(2) of the Cr.P.C.
