JUSTICE MUNGESHWAR SAHOO ORAL ORDER 14-10-2015 Heard the learned counsel for the petitioners and learned A.P.P. for the State.

The petitioners, namely, Sanjay Yadav, Satyendra Yadav, Sanjay Paswan, Ambika Yadav, Mahendra Yadav, Jai Prakash Thakur and Om Prakash Thakur apprehend their arrest in Alipur P.S. Case No.43 of 2015 under Sections 147, 148, 149, 341, 323, 324, 307, 337, 338, 153A, 109, 195, 504, 506 and 509 of the Indian Penal Code and 27 of the Arms Act. The learned counsel for the petitioners submitted that there is case and counter case between the parties. 27 accused

Patna High Court Cr.Misc. No.42152 of 2015 (2) dt.14-10-2015 persons are named in the FIR and the FIR is against 50-60 unknown persons also. Out of the named 27 accused persons, 7 accused persons have already been granted anticipatory bail by this Court in Cr. Misc. No.42724 of 2015 and 47470 of 2015. The case of the petitioners stand on same footing. The learned A.P.P. did not dispute this fact. Considering the fact that the other co-accused persons whose case is on same footing have already been granted anticipatory bail, I direct the petitioners named above to surrender before the court below within six weeks from today and on their so surrendering, the court below is directed to release the petitioners on bail on furnishing bail bond of Rs.5,000/-(Rupees five thousand) each with two sureties of the like amount each to the satisfaction of Sri Jigar Sah, learned Judicial Magistrate 1st Class, Gaya in connection with Alipur P.S.
