In this application for anticipatory bail the petitioner apprehends her arrest for the offences punishable under section 306 of the I.P.C.
Allegedly, sister of the informant committed suicide after hanging herself. She was married about 14 years ago with the son of the petitioner and she was blessed with two sons and two daughters and her husband was living abroad and allegedly the petitioner used to torture her.
Submission is of false implication and that the deceased was suffering from mental disease and after realizing the truth the informant has filed compromise petition along with
Patna High Court Cr.Misc. No.50461 of 2014 (2) dt.07-05-2015 2/2 permission petition before the learned court below. The son of the deceased in paragraph-11 of the case diary has stated that his mother always used to fight with grand mother and due to that his mother has committed suicide and as such the petitioner deserves sympathetic consideration, to which the learned A.P.P. opposes. Considering that the marriage was solemnized long long ago and due to some quarrel between the deceased and the petitioner the deceased committed suicide after hanging herself and as good sense has prevailed between the parties and as such the petitioner in case of her arrest or surrender within two months from the date of receipt/production of a copy of this order shall be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of. C.J.M. Siwan in Ziradei P.S. Case No. 49 of 2014, subject to the conditions as laid down in section 438 (2) of the Cr.P.C.
