JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 16-01-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner happens to be dewar of the complainant and apprehends his arrest in connection with Complaint Case No. 1080 C of 2012 in which cognizance has been taken for the offences punishable under Sections 365/34 of the Indian Penal Code.
Originally, the complainant lodged Singheshwar P.S. Case No. 52 of 2011 in respect of missing of her husband levelling serious allegation against the petitioner and other accused but after due investigation, police found the accusation untrue and accordingly, the final form was submitted but learned court below took cognizance of the offence on the basis of protest cum

Considering the aforesaid facts and circumstances as well as submissions of the parties particularly, keeping in mind that partition suit is pending between the parties, this anticipatory bail petition is allowed and it is ordered that petitioner, in the event of his arrest/ surrender within four weeks from the date of receipt of this order to the court concerned, shall be released on bail on furnishing bail bonds of Rs 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Sub Divisional Judicial Magistrate, Madhepura in Complaint Case No. 1080 C of 2012 subject to condition as laid down under Section 438(2) of the Cr.P.C.
