In this case, the petitioner is seeking anticipatory bail in connection with Ujiarpur P.S. Case No. 92 of 2017, registered for the offence under Sections 145, 186, 342, 323, 353, 379, 427, 435 and 504 of the Indian Penal Code. An accident took place by Magic vehicle near Yogi Chown Gaopur, in which a child died. On that account, local people block the road and paralyzed the vehicular movement. The petitioner has been named as accused no.10 in the F.I.R. Learned counsel for the petitioner submits though the name of the petitioner has been mentioned in the F.I.R, but no specific allegation has been made against him. He further

Patna High Court CR. MISC. No.20511 of 2019(2) dt.03-04-2019 2/2 submits that one Vijay Singh, who has also been named in the F.I.R., has been granted anticipatory bail by this Court in Criminal Miscellaneous No.72455 of 2018.

Considering the aforesaid facts, let the abovenamed petitioner be released on anticipatory bail in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand Only) with two sureties of the like amount each to the satisfaction of the Sub-Divisional Judicial Magistrate, Dalsingsarai, Samastipur, in connection with Ujiarpur P.S. Case no. 92 of 2017 subject to the condition as laid down under Section 438(2) of the Code of Criminal Procedure. Further condition is that whenever the police will call the petitioner for the purposes of investigation and interrogation, he will remain present for the investigation. In the event of being absent on two consecutive dates without reasonable explanation, the present order will be treated to have been cancelled.
