JUSTICE DINESH KUMAR SINGH ORAL ORDER 02-11-2015 Petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 341, 323, 354(B), 504/34 of the Indian Penal Code and Section 3(1)(x) of the SC & ST (Prevention of Atrocities) Act. The prosecution case is that accused persons were flowing water on the land of the informant, on protest being made the informant and her son were abused and assaulted.

It is submitted by learned counsel for the petitioners that in the background of land dispute the accusation has been levelled and on conclusion of the investigation, final form/charge-sheet has been submitted under Sections 341, 323, 504, 506/34 of the Indian Penal Code and Section 3(1)(x) of the SC & ST (Prevention of Atrocities) Act.

No.43707 of 2015 (3) dt.02-11-2015 2/2 The aforesaid facts constitute ground for consideration of prayer for regular bail, if the petitioners surrender within a period of six weeks in connection with SC/ST P.S. Case No. 50 of 2014, pending in the Court of learned Additional Chief Judicial Magistrate, Madhubani. It is expected from the learned Court below to dispose of the application, preferably on the same day.

With the observations above, the application stands disposed off.
