The petitioner apprehends his arrest in connection with Ara Mufassil P.S. Case No. 268 of 2015 registered for the offences punishable under Sections 302/201 the Indian Penal Code.
Learned counsel for the petitioner submits that the petitioner has falsely been implicated in this case as the dispute had arisen between the petitioner and the local contractors, who had been engaged for setting up electric lines. It is further submitted that deceased was just a driver of the Magic Vehicle which was owned by one Dharmendra Paswan. It is further submitted that the son of the Dharmendra Paswan had stated that

No.42615 of 2015 (3) dt.14-12-2015 actually there was no dispute between the deceased and the present petitioner rather the dispute had arisen between the local contractors, who had been engaged for setting up electric wire. Considering the nature of allegation and also the fact that there is no cogent material in the case diary to connect the petitioner in the aforesaid offence, let the petitioner above named, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, be enlarged on bail on furnishing bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Ara in connection with Ara Mufassil P.S. Case No. 268 of 2015, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.. (Anjana Mishra, J) Jagdish/- U T
