JUSTICE SAMARENDRA PRATAP SINGH ORAL ORDER 13-10-2015 Petitioner apprehend his arrest in a case under sections 380 and 411 of Indian Penal Code.

The petitioner submits that he has not been named in the FIR nor there is any recovery of his hose, rather he has been named by co-accused Shiv Shankar Kumar.

In the facts of the case, the prayer for bail of the petitioner is refused with direction to surrender and seek regular bail which would be disposed of preferably on the same day, on its own merit, without prejudice, and also taking into consideration that there is no recovery from him and has not been named in the FIR.
