This is an application for grant of regular bail for offences punishable under Section 414/34 of the Indian Penal Code.
It has been submitted on behalf of the petitioner that name of the petitioner has been inserted in the First Information Report only on the basis of confessional statement made by a coaccused of this case, who in his confession stated that he along with petitioner and one other had assembled to a particular place to sell the stolen motorcycles. Learned counsel for the petitioner further stated that though the petitioner has criminal antecedent, however, all the cases have been falsely instituted against him
Patna High Court Cr.Misc. No.55223 of 2016 (2) dt.09-01-2017 2/2 after he was intercepted in the present case and the petitioner has been in judicial custody since 16.09.2016.
Heard learned A.P.P. also.
Considering the facts and circumstances of the case, period of detention and also that the petitioner's name transpired in this case only on the basis of confessional statement of coaccused, let the petitioner above named, be released on bail on furnishing bail bonds of Rs. 10,000 (Rs. Ten Thousand) with two sureties of the like amount each to the satisfaction of learned ACJM-V, Samastipur, in connection with N.H. Bangra P.S. Case No. 39 of 2015. .
