2. The petitioner is apprehending arrest in connection with Shakurabad P.S. Case No. 243 of 2025, dated 21.08.2025, lodged under Sections 126(2), 115(2), 303(2), 109, 352, 351(2) & 3(5) of the Bhartiya Nyaya Sanhita, 2023 (hereinafter referred to as "BNS, 2023").

As per the prosecution, an FIR has been lodged against three named accused persons, including the present petitioner, alleging that all the accused entered the informant's house and assaulted the occupants with lathi, danda, and iron rod, causing injuries. It is further alleged that Rs. 10,000/- was snatched during the incident.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. Counsel further submits that both parties are adjacent neighbors and distant relatives. It is submitted that a scuffle took place on 19.08.2025, resulting in injuries to both sides. One party lodged a criminal case on 21.08.2025, while the other party lodged a criminal case on 31.08.2025, both arising from the same date and place of occurrence.

5. Counsel further submits that the present petitioner is a student studying at an ITI institute in Jehanabad and is being unnecessarily made an accused in the present case, allegedly to create pressure. Counsel also submits that the petitioner is willing to comply with any conditions that may be imposed upon him.

6. Learned APP for the State opposes the prayer for bail of the petitioner but fairly submits that a certificate has been attached showing that the petitioner is studying in an ITI institute.

7. As such, in the present facts and circumstances of this case, let the above named petitioner be released on anticipatory bail, in the event of arrest or surrender before the Trial Court within a period of 4 weeks from today, on furnishing

Case No. 243 of 2025, subject to the conditions as laid down U/s 482(2) of the BNSS, 2023.
