Mr.Rabindra Kumar ====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 28-01-2022 Heard both parties through video conferencing. The petitioner seeks bail in Ariyari (Kesar OP) P.S. Case No. 126 of 2020, registered for the offence punishable under Sections 302, 201, 34 of the Indian Penal Code. As per the FIR, informant suspects that this petitioner along with other accused persons killed his niece Shilpi Kumari and disposed of her dead body. Petitioner is step-mother of the deceased.

It is submitted on behalf of the petitioner that during course of investigation, it has come that Shilpi Kumari has committed suicide and except confessional statement of coaccused Bijay Yadav there is no material which shows complicity of this petitioner in the alleged occurrence. Petitioner claims clean antecedent and she is in custody since 18.01.2021.

No.30612 of 2021(4) dt.28-01-2022 2/2 However, counsel for State opposed the bail application and submitted that the doctor has found cause of death Asphyxia due to strangulation and there is specific and direct allegation against this petitioner who is step-mother of deceased of commission of murder.

Considering the rival submissions of the parties and material available on record, the petitioner above-named, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Sheikhpura in connection with Ariyari (Kesar OP) P.S. Case No. 126 of 2020.
