JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 23-11-2016 Heard learned counsel for the petitioner and learned counsel representing the State.

The petitioner wants to renew his prayer of bail, which was earlier rejected vide order dated 29.03.2016 passed in Cr. Misc. No. 4722 of 2016, on the ground that the petitioner is in custody since 29.10.2015 after his surrender, other co-accused Nogo Rishi has been allowed bail and as such the petitioner also deserves sympathetic consideration to which the learned APP opposes by submitting that against the petitioner there is allegation that he assaulted the father of the informant with Dabiya on his head and doctor has found head injury and as such the petitioner is the assailant.

In the facts and circumstances stated above, finding no good ground for reconsideration of prayer for bail of the petitioner, again his prayer for bail stands rejected in connection

Patna High Court Cr.Misc. No.48085 of 2016 (2) dt.23-11-2016 with Sessions Trial No. 569 of 2015 pending in the court of learned 3rd Additional Sessions Judge, Purnea. However, considering the period of detention, let the trial be expedited and concluded as early as possible, preferably within six months from the date of receipt/production of a copy of this order.
