JUSTICE ASHWANI KUMAR SINGH ORAL ORDER 2 20-11-2017 The petitioner has filed the present application under Section 482 of the Code of Criminal Procedure for quashing the first information report of Sitamarhi S.C./S.T. P.S. Case No. 45 of 2016 registered under Sections 341, 323, 448, 379, 504, 506 and 427/34 of the Indian Penal Code and Section 3(1)(s)(g) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act.
At the outset, it is submitted by the learned counsel for the petitioner that during pendency of the application, the learned Additional Sessions Judge-cum-Special Judge,
Patna High Court Cr.Misc. No.17258 of 2017 (2) dt.20-11-2017 Sitamarhi vide order dated 12.07.2017 took cognizance of the offence pursuant to submission of the police report. In view of the subsequent developments, which took place during pendency of the application and the case having reached to the next stage, the instant application as well interlocutory application no.2339 of 2017 are disposed of with liberty to the petitioner to challenge the aforesaid order dated 12.07.2017 passed by the learned Additional Sessions Judge-cum-Special Judge, Sitamarhi by filing another appropriate application.
