On confessional statement of co-accused Hira Lal Chaurasia @ Matar Lal Chaurasia disclosing therein that he along with Krishna Nand Chaudhary, Raju Chaudhary, Dilip Sahani were engaged in preparing spurious wine in the house of Md. Shamim Ansari (petitioner) whereupon raid was conducted and during course thereof, it has been alleged that four persons succeeded in their escape, who were disclosed by the witnesses to be Shamim Ansari, Krishna Nand Chaudhary, Raju Chaudhary and Dilip Sahani. Furthermore, it has also been disclosed that on search, empty bottles as well as sealed, packed bottles of countrymade wine as well as foreign liquor were seized in terms of seizure list.

No.47403 of 2016 (02) dt.08-11-2016 From perusal of the self-statement, it is apparent that status of petitioner happens to be that of landlord and further, as is evident though his name transpired, but was not arrested at the spot. As per order impugned, it is apparent that petitioner had surrendered on 02.07.2016 and is under custody since then and from Para-3 of the bail petition, it is apparent that petitioner has got no criminal antecedent.

That being so, petitioner, Md. Shamim Ansari is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Purnea in connection with K. Hat (Sahayak) P. S. Case No.105 of 2016.
