JUSTICE ARUN KUMAR ORAL ORDER 18-03-2017 Heard learned counsels for the petitioner and the State. The petitioner apprehends his arrest in connection with Gamharia P.S. Case No. 84/2016 instituted under Sections 147, 148, 149, 341, 323, 353, 307, 337, 338 and 427 of the Indian Penal Code.

The allegation, in brief, is that more than 250 persons, making unlawful assembly, were protesting for re-counting votes of the Panchayat Mukhiya election in the leadership of Meena Devi, one of the candidates and they resorted to brick-batting and firing.

Learned counsel appearing on behalf of the petitioner submits that there is no specific allegation against the petitioner and it was Meena Devi, a candidate of Mukhia was insisting for re-counting, has been granted anticipatory bail as well as other 22 named co-accused of

Having considered the aforesaid facts and circumstances, let the petitioner, namely, Subhash Kumar in the event of arrest or surrender before the court below within four weeks from today, be released on bail upon furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate IV, Madhepura in connection with Gamharia P.S. Case No. 84/2016; subject to the condition as laid down under Section 438(2) of the Code of Criminal Procedure, 1973. (Arun Kumar, J.) Rakhi U T
