The petitioner seeks bail in Balthar P.S. Case No.4 of 2016 instituted for the offences under Section 392 of the Indian Penal Code.

Allegation has been made that some unknown persons intercepted the victim and taken away Rs.1,25,000/-. On the basis of the confessional statement of another co-accused the police raided the house of the petitioner and from there looted money along with country made pistol and one mobile has been recovered.

Learned counsel for the petitioner submits that for Arms Act different case was lodged in which he has been

Patna High Court Cr.Misc. No.45787 of 2016 (2) dt.22-10-2016 granted bail. He has further submitted that money and mobile belongs to the petitioner. He further submits that one Ahmad Miyan has been granted bail by this Court vide Cr. Misc. No. 40507 of 2016. At the same time, he has further submitted that after arrest he has been implicated in 3-4 cases. Looking to the nature of allegation, this Court is not inclined to enlarge the petitioner on bail. Accordingly the prayer for bail is rejected. However, the petitioner will be at liberty to renew his prayer for bail after completion of nine months of jail custody.
