JUSTICE MOHIT KUMAR SHAH ORAL ORDER 23-03-2023 The present writ petition has been filed seeking the following reliefs:- 1(i). For issuance of writ in the nature of mandamus commanding and directing the Respondents Authority to shift the Government Primary School, Sukulpur in any appropriate land as the land Survey Plot No. 1021 is recorded in the name of grandfather of the petitioner and the School in question was temporarily allowed in the said house standing over the Plot No. 1021 due to none availability of the building of the school in question.

(ii). For further direction to the Respondents Authority to hold an inquiry that under what condition the Primary School, Sukulpur is running

Patna High Court CWJC No.15067 of 2015(2) dt.23-03-2023 2/2 in the building of the petitioner who has not been paid any rent or remuneration nor the land has been acquired for running the said School.

(iii). For further direction to the respondents authority to vacate the land in question within stipulated period and give possession to the petitioner.

(iv). For further direction to the respondents authority to dispose of the representation of the petitioner by reasoned and speaking order within time framed."

After some arguments, the learned counsel for the petitioner seeks not to press the present writ petition, however, seeks liberty on behalf of the petitioner to avail such other alternative remedies as are otherwise available under the law. Liberty, so sought, is granted.
