JUSTICE ASHWANI KUMAR SINGH ORAL JUDGMENT Date: 12-08-2016 By way of the present application preferred under Section 482 of the Code of Criminal Procedure, the petitioner seeks quashing of the order dated 15.04.2013 passed by the Judicial Magistrate, 1st Class, Aurangabad (Bihar) in connection with Complaint Case No. 313 of 2012 whereby cognizance of the offences punishable under Sections 193, 199, 200 and 211 of the Indian Penal Code has been taken.

At the outset, it has been brought to the notice of the

Patna High Court Cr.Misc. No.42514 of 2013 dt.12-08-2016 2 / 2 Court by the learned counsel for the opposite party No. 2 that during pendency of the present application, charges have already been framed and one witness has also been examined during trial. Regard being had to the stage of the case, I am not inclined to interfere with the order which was passed more than three years back.

Accordingly, the application is dismissed.
