Heard learned counsel for the petitioner and learned APP for the State.

Since the physical court proceeding is nonfunctional, due to present pandemic, COVID-19, the matter is listed with defects.

Learned counsel for the petitioner undertakes to remove the defects within three weeks of resumption of physical court proceeding. In the eventuality of non-removal of defects within undertaken period, the office will place the matter before the bench.

The present application has been filed for

Patna High Court CR. MISC. No.20395 of 2020(2) dt.13-08-2020 2/2 modification of order dated 16.03.2020 passed in Cr. Misc. No. 77357 of 2019 to the extent of extending the period of surrender. It appears that the petitioner was granted anticipatory bail vide order dated 16.03.2020 passed in Cr. Misc. No. 77357 of 2019 in connection with Isuapur P.S. Case No. 108 of 2017 registered for the offences punishable under Sections 120B, 323, 307, 341, 379, 504/34 of the Indian Penal Code and Section 27 of the Arms Act, pending in the Court of learned Sub-divisional Judicial Magistrate, Saran at Chapra.

Considering the grounds taken in the modification application that due to the lockdown in the present pandemic, the petitioner could not surrender within the stipulated period, the period of surrender is further extended by three weeks from the date of receipt/production of a copy of this Court. Accordingly, the modification application stands disposed of.
