The petitioners are accused in connection with Araria P.S. Case No. 271 of 2016 registered under sections 461 and 379 of the I.P.C. pending in the Court of Sub-Judge-II, Araria. The accusation is that some unknown miscreants entered in the factory of the informant and took away cash Rs. 1,00,000/- and mobile.

Learned counsel appearing on behalf of the petitioners submits that petitioners have falsely been implicated in this case. It is also submitted that petitioners have got no criminal antecedent.

Learned A.P.P. opposed the prayer of the petitioners

Patna High Court Cr.Misc. No.49487 of 2016 (3) dt.23-12-2016 2/2 with submission that the names of the petitioners have come on the basis of confessional statement of co-accused Md. Taiyab, who disclosed that the petitioners entered in the factory after breaking the wall and took away cash and mobile, which have been recovered from the possession of the petitioners. Having considered the facts and circumstances of the case and nature of allegation, I am not inclined to allow the prayer of the petitioners for bail. Accordingly, prayer of the petitioners for bail is rejected.
