JUSTICE BIRENDRA KUMAR ORAL ORDER 18-03-2017 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 376, 511, 504 and 506/34 of the Indian Penal Code.

Allegation is that the petitioner wanted to forcefully marry with the daughter of the informant. Further allegation is that he attempted to outrage her modesty on non-fulfillment of his desire.

Submission of the petitioner is the parties have settled their scores as well as the daughter of the informant has already married with some other boy which has been accepted by the petitioner and written compromise petition has been filed.

Patna High Court Cr.Misc. No.12883 of 2017 (2) dt.18-03-2017 Considering the aforesaid facts, let the petitioner, above named, in the event of his arrest or surrender before the court below within a period of thirty days from the date of receipt of the order, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Motihari, East Champaran/Successor Court in connection with Dumariyaghat P.S. Case No.41 of 2016, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure and subject to the further condition that the petitioner shall not indulge in such activity against the daughter of the informant in future.
