JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 13-05-2015 This is an application for initiation of contempt proceeding for disobedience of this Court's order dated 23.6.2015 passed in CWJC No. 15329 of 2012.
From the statement made in paragraph 6 of the show cause reply filed today on behalf of Opposite party no.5, to me it appears that the order of this Court has substantially been complied with.
Learned counsel for the petitioner has submitted that only
Patna High Court MJC No.4789 of 2014 (3) dt.13-05-2015 arrears of salary have been paid and actual salary has not been paid to the petitioner. I have failed to appreciate this submission. However, the petitioner shall be at liberty to approach the District Programme Officer ( Establishment), Patna for payment of any amount which according to him, is still payable after payment of amount ( Rs. 81,395/-) as disclosed in paragraph 6 of the show cause reply. The Court expects that if the petitioner approaches the District Programme Officer (Establishment), Patna raising any grievance with respect to payment of any further amount giving details of calculation in support of his claim, the District Programme Officer (Establishment), Patna will consider it and pass necessary orders within a period of three months. It goes without saying that if according to the petitioner, the grievance still remains, he will be at liberty to approach the Appellate Tribunal for redressal of his grievance. This application is disposed of accordingly.
