JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 04-10-2016 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner apprehends his arrest in connection with Katoria P.S. Case No. 188 of 2011, registered under Sections 147, 148, 149, 341, 323, 324, 325, 307 and 302 of the Indian Penal Code. Learned counsel for the petitioner submits that 26 persons named in the F.I.R., including the petitioner, and some other unknown reached at the house of the informant, but there is specific allegation against Nilkanth Mandal, who ordered to kill the Sunil Mandal, brother of the informant, thereafter, accused Dilip Mandal and Subodh Mandal caused injury to Sunil Mandal, who died. There is no specific overt act against the petitioner. Further submission is that other co-accused Baldeo Das and Tuntun Das have already been granted Anticipatory Bail vide order dated 21.07.2015 passed in Criminal Miscellaneous No. 27457 of 2015.

No.38864 of 2016 (2) dt.04-10-2016 2/2 Having regard to the facts and circumstances of the case, let the above named petitioner, be released on bail, in the event of his arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Banka in connection with Katoriya P.S. Case No. 188 of 2011, subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
