The petitioner being the husband of the victim is apprehending arrest in a case registered for the offences punishable under Sections 328 and 302/34 of the Indian Penal Code.
The prosecution case is of killing the daughter of the informant within one year of the marriage by administering poison.
It is submitted by learned counsel for the petitioner that the husband of the victim (petitioner) is a labour and was outside the State on the date of alleged occurrence for earning his livelihood and the informant
Patna High Court Cr.Misc. No.43042 of 2015 (2) dt.14-10-2015 2/2 has retracted from the initial version and filed a petition to that effect before the learned court below.
It is submitted by learned counsel for the petitioner that others have been granted anticipatory bail. Let the learned court below consider the prayer for regular bail of the petitioner, if the petitioner surrenders before the learned court below within a period of six weeks from today in connection with Sursand P.S. Case No. 81 of 2010 pending in the court of learned Sub-divisional Judicial Magistrate, Pupri, District - Sitamarhi.
With the aforesaid observation, this application is disposed of.
