1. Heard learned counsel for the petitioners and learned A.P.P. for the State.

2. The petitioners apprehend their arrest in a case registered for the offence punishable under Sections 147, 148, 149, 341, 323, 379, 504 and 506 of the Indian Penal Code.

3. Learned counsel for the petitioners submits that petitioner no.1 and 2 have antecedent of one case and the petitioner no.3 is a person with clean antecedent and have been falsely implicated in the instant case by the informant. It is next submitted that the allegation against petitioner no.1 is of assaulting the informant by lathi, causing injury and as far as petitioner no.2 is

No.27878 of 2024(3) dt.15-05-2024 2/2 concerned, he is alleged to have snatched the gold chain of the informant, while allegation against petitioner no.3 is general and omnibus in nature. It is further submitted that no doubt the injured suffered injury on head but then the same was not caused on account of assault by lathi, as would manifest from the allegation as alleged in the F.I.R. It is also submitted that the injury suffered by the injured is simple in nature.

4. Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioners.

5. Considering the submissions made by the learned counsel for the petitioners, the petitioners above-named, in the event of their arrest or surrender before the learned Court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned trial court where the case is pending/successor court in connection with Chanpatia P.S. Case No.691/2023, subject to the conditions as laid down under Section 438 (2) of the Cr.P.C. (Satyavrat Verma, J) amit/- U T
