JUSTICE VINOD KUMAR SINHA ORAL ORDER 10-12-2018 The petitioner seeks regular bail in connection with Falka P.S. Case No. 376 of 2018, registered for offences punishable under Section 414 of the Indian Penal Code and Section 30(a) of the Bihar Prohibition and Excise Act, 2016. Allegation is of recovery of 300 litres of country made liquor from the tempo of the petitioner.

It has been submitted on behalf of the petitioner that the F.I.R. itself shows that recovery has been made from other persons, who were sitting in the tempo and petitioner being driver of the tempo has falsely been made accused in this case. Further he has no criminal antecedent and has been in judicial custody since 13.09.2018.

Heard learned A.P.P. also.

Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Additional District & Sessions Judge -II cum Special Judge, Katihar, in connection with Falka P.S. Case No. 376 of 2018.
