The petitioner is apprehending arrest in connection with Sikti P.S. Case No. 233 of 2017 for offences under Sections 414, 420, 467, 468 of the Indian Penal Code. Counsel for the petitioner submits that the petitioner has no criminal antecedent. The story of stolen motorcycle is precisely false as the petitioner is the owner of the same which is alleged to be the stolen one and for which present case has been registered.
Considering the fact that the petitioner claims to be the owner of the vehicle in question, the court is inclined to grant provisional anticipatory bail to the petitioner for a period of two months on the condition that the Court below will verify
Patna High Court Cr.Misc. No.71168 of 2018(2) dt.17-12-2018 2/2 the owner book which has been seized by the police along with the motorcycle bearing registration No. BR11J 9527 and on satisfaction as to ownership of the vehicle in question, the court below will make the provisional bail absolute. In view of the above, let the petitioner, above named, in the event of arrest or surrender within four weeks from today, be released on provisionally bail for a period of two months on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the S.K.Sharma, J.M. 1st Class, Araria in connection with Sikti P.S. Case No. 233 of 2017, subject to the conditions as laid down under Section 438(2) Cr. P. C.
