JUSTICE ARUN KUMAR ORAL ORDER 10-02-2017 Heard learned counsel for the petitioner and the State. The petitioner apprehends his arrest in connection with Mashrakh P.S. Case No. 361 of 2016 registered under Sections 272, 273 of the Indian Penal Code and 30(a), 38/41 of Bihar Excise Amendment Act, 2016.

Allegation is that the police recovered 25 litres of country made liquor kept in a drum and concealed under the ground in the field of Rajbanshi Singh and Mahant Singh and the villagers disclosed that this petitioner had concealed the drum. It is submitted that the said liquor was neither recovered from the possession of the petitioner nor from his land and the F.I.R. also does not disclose this fact and no particular person has disclosed the name of the petitioner. Moreover, this petitioner has no criminal antecedent.

Considering the aforesaid facts and circumstances, in the event of their arrest/surrender within four weeks from the date of receipt of this order to the concerned court, let the petitioner, namely, Umesh Singh be released on bail on furnishing bail bond

Patna High Court Cr.Misc.
