IN THE HIGH COURT OF JUDICATURE AT PATNA

Criminal Miscellaneous No. 39461 of 2016 Arising Out of PS.Case No. -206 Year- 2013 Thana -KARAHGAR District- SASARAM (ROHTAS) ====================================================== Daya Shankar Ram, son of Sri Niwas Ram, resident of Village: Chhotaka Katara, P.S. Mohania, District: Kaimur.

.... .... Petitioner

Versus

The State of Bihar .... .... Opposite Party ====================================================== Appearance :

For the Petitioner : Mr. Sada Nand Roy, Advocate For the Opposite Party : Mr. Sri Rana Randhir Singh (APP) ====================================================== CORAM: HONOURABLE MR. JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 14-09-2016 Heard learned counsel for the petitioner and the learned A.P.P. representing the State.

The petitioner wants to renew the prayer of bail which was earlier twice rejected by order dated 04.03.2014 and 18.01.2016 passed in Cri. Misc. No. 52300 of 2013 and Cr. Misc. No. 53704 of 2015, on the ground that petitioner is in custody since 26.07.2013 and in near future the trial is not likely to be concluded, as up till now only one prosecution witness has been examined, though there was direction to conclude the trial preferably within six months.

Learned A.P.P. opposes the prayer of bail by submitting that the petitioner was seen fleeing away with fire arm and thereafter the informant's injured son was brought to hospital,

Patna High Court Cr.Misc. No.39461 of 2016 (2) dt.14-09-2016 2/2 where he died.

In the facts and circumstances stated above, finding no good ground for reconsideration of prayer of bail, again the prayer for bail of the petitioner stands rejected. However, the learned trial court is directed to expedite the trial and conclude the same preferably within four months after receipt/production of a copy of this order, failing which if the petitioner at no fault, may be at liberty to renew his prayer for bail.
