The petitioner apprehends his arrest in Complaint Case No. 6276/2015, registered for the offences punishable under Section 498(A) of the Indian Penal Code and section 4 of the Dowry Prohibition Act.
Learned counsel for the petitioner submits that the wife made allegation of demand of dowry and torture against the petitioner and others, but the case was compromised and the petitioner was granted anticipatory bail vide order dated 24.05.2016 passed in A.B.P. No. 411/15, but the petitioner could not surrender in the court below and did not furnish the bail bonds.
Patna High Court Cr.Misc. No.17341 of 2017 (2) dt.04-05-2017 2/2 The petitioner again filed the petition for anticipatory bail which was rejected on 07.02.2017. In my view, once the petitioner was granted anticipatory bail the second petition for anticipatory bail is not maintainable.
Considering the facts aforesaid, this anticipatory bail is dismissed.
