The petitioner apprehends his arrest in Saraiya P.S. Case No. 263 of 2016 instituted for the offence under Section (s) 406, 409, 420, 188 of the Indian Penal Code. It has been submitted that work has already been completed for which letter has been sent by the informant himself to the officer-in-charge, Jaitpur, police station. As per written report, there is allegation against the petitioner that petitioner withdrew Rs. 9,67,000/- for construction of extra class room in the school and the same was not completed.

No.14014 of 2017 (2) dt.27-03-2017 2/2 It appears from Annexure-2 that informant himself has informed to the officer-in-charge, Jaitpur police station that construction work of extra class room for which the petitioner was given Rs. 9,67,000/- as advance has been completed and no due is lying with the petitioner.

In the facts and circumstances of the case, the prayer of the petitioner for anticipatory bail is allowed. In the event of surrender/arrest of the petitioner, above named, within six weeks from today in connection with Saraiya P.S. Case No. 263 of 2016, he shall be released on anticipatory bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Muzaffarpur, subject to the conditions as laid down under Section 438(2) of Cr.P.C.
