Petitioner seeks bail in a case registered for the offences punishable under Sections 302 and 304/34 of the Indian Penal Code.
Earlier prayer for regular bail was refused on 03.04.2018 in Cr. Misc. No. 10138 of 2018 as the petitioner is husband of the victim of dowry death. This Court had directed the trial court to expedite the trial.
The report of the learned Sessions Judge, Darbhanga reveals that seven prosecution witnesses have already been examined who are named in the charge sheet. The impugned order further reveals that the witnesses examined turned hostile. The trial court is directed to examine the remaining
Patna High Court Cr.Misc. No.67652 of 2018(3) dt.13-02-2019 2/2 witnesses and conclude the trial within a period of six months from the date of receipt/production of a copy of this order. Let the Superintendent of Police, Darbhanga be informed to take necessary step for production of the remaining charge sheet witness in this case.
