The petitioners apprehend their arrest in Turkauliya (Banjariya) P.S. Case No. instituted for the offence under sections 376, 313, 315, 120(B)/34 of the Indian Penal Code and 4/6 Protection of Children from Sexual Offence Act. It is alleged that Akhilesh Mahto established physical relationship with the daughter of the informant on the pretext to marry and she became pregnant.

There is allegation against these petitioners that they took the daughter of the informant in a private clinic where pregnancy of informant's daughter was got aborted.

Patna High Court Cr.Misc. No.11656 of 2017 (2) dt.20-03-2017 2/2 It is submitted that girl has already been married with Akhilesh Mahto and a compromise petition has also been filed in the Lower Court and in support thereof, Annexures -2 and 3 have been filed.

Considering the facts and circumstances of the case, prayer for anticipatory bail of the petitioners is allowed. In the event of surrender/arrest of the petitioners named above, within six weeks from today, in connection with Turkauliya (Banjariya) P.S. Case No. 390 of 2016, they shall be released on anticipatory bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned 1st Additional Sessions Judge, Motihari, East Champaran, subject to the conditions as laid down under Section 438(2) Cr.P.C.
