JUSTICE MOHIT KUMAR SHAH ORAL ORDER 10-05-2023 The present petition has been filed for restoration of a petition bearing Criminal Miscellaneous No. 1716 of 2023, which has stood dismissed for non-compliance of the peremptory order of this Court dated 6.2.2023. The learned counsel for the petitioner has submitted that on account of certain personal difficulties, the learned counsel for the petitioner of the aforesaid case could not remove the defects in time, however, now the same has already been removed, hence, a sympathetic view be taken and the aforesaid petition be restored to its original file.

Having regard to the facts and circumstances of the case, considering the submissions made by the learned counsel for the petitioner as also considering the averments made in the

Patna High Court CR. MISC. No.25424 of 2023(2) dt.10-05-2023 2/2 present petition, I deem it fit and proper to direct for restoration of the aforesaid petition bearing Criminal Miscellaneous No. 1716 of 2023 to its original file, subject to verification by the registry as to whether the defects have been removed by the petitioner or not.

The present restoration petition stands disposed off on the aforesaid terms.
