2. Heard Mr. Dharmendra Kumar Paswan, learned counsel for the appellant as well as Mr. Binay Krishna, learned Spl.P.P. for the State.

3. This is an appeal under Sections 14(A)(2) against refusal of the prayer for anticipatory bail by order dated 16.02 2026 passed by the learned Exclusive Special Judge SC/ST Vaishali at Hajipur in A.B.P No. 47 of 2023 arising out of SC/ST P.S. Case No. 20 of 2023, registered for the offences

2/5 under Sections 147, 341,323,354-B, 324, 447, 380, 504, 506 of the Indian Penal Code and Sections 3(1)(r), 3(1)(s)(w), 3(2)(va) of the SC/ST Act.

According to the prosecution case, the informant has alleged that on 12-05-2023 at about 12:00 A.M. when he went to orchard, near Bank of river for natural call, in the meantime co-accused Ramchandra Singh came there and pulled her saree, assaulted her and pulled on earth. On hulla, when her son came to save, then the appellant along with other accused persons came there and assaulted and abuse to her caste name. Further alleged that other accused persons and 5 to 6 unknown persons came there and they also abused and assaulted them. It is further alleged that co accused Manish Kumar entered into informant's house and took away one Attachi worth Rs. 2,00,000/- of jewellary.

5. Learned counsel for the appellant submits that appellant has clean antecedent and he has falsely been implicated in the present case. He further submits that the allegation as alleged in the F.I.R. is false and fabricated and the appellant has not committed any offences as alleged in the F.I.R. He next submits that there is no specific allegation of assault or overt act attributed against this petitioner and one of the co-

3/5 accused, namely, Ram Chandra Singh, against whom there is specific allegation of assault has been granted the privilege of anticipatory bail by a co-ordinate Bench of this Court vide order dated 23.02.2024 in Cr. Appeal(SJ) No. 3348 of 2023 and other co-accused persons, namely, Sanjay Kumar @ Sanjay singh and Manish Kumar @ Kare Singh have been granted the privilege of anticipatory bail by this Court vide order dated 15.07.2025 in Cr. Appeal(SJ) No.4380 of 2023.

6. Learned Special Public Prosecutor for the State has vehemently opposed the prayer for bail of the appellant.

7. After hearing the parties, in my view for the purpose of this anticipatory bail, no offence under the provisions of Scheduled Castes and Scheduled Tribes Act is made out.

Considering the aforesaid facts and circumstances and the fact that appellant has clean antecedent and there is no specific allegation of assault or overt act attributed against him and co-accused persons have been granted the privilege of anticipatory bail by this Court or co-ordinate Bench of this Court, let the appellant, above named, in the event of his arrest or surrender before the Court below within a period of thirty days from the date of receipt of the order, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/- (Ten

4/5 thousand) with two surities of the like amount each to the satisfaction of learned Court of Exclusive Special Judge SC/ST Vaishali at Hajipur in connection with SC/ST P.S. Case No. 20 of 2023, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure / Section 482(2) of the Bhartiya Nagarik Suraksha Sanhita, 2023 and with other following conditions:- i. Appellant shall co-operate in the trial and shall be properly represented on each and every date fixed by the court and shall remain physically present as directed by the court and on his absence on two consecutive dates without sufficient reason, his bail bond shall be cancelled by the Court below. ii. If the appellant tampers with the evidence or the witnesses, in that case, the prosecution will be at liberty to move for cancellation of bail.

iii. And further condition that the court below shall verify the criminal antecedent of the appellant and in case at any stage it is found that the appellant has concealed his criminal antecedent, the court below shall take step for cancellation of bail bond of the appellant. However, the acceptance of bail bonds in terms of the above-mentioned order shall not be delayed for purpose of or in the name of

9. Accordingly, the impugned order is set aside and this appeal stands allowed.
