The petitioner, Md. Kadir Ansari, apprehends his arrest in Sitamarhi P.S. Case No.654 of 2014, registered under Sections 498A and other sections of the Indian Penal Code and Section 3/4 of the Dowry Prohibition Act.

Jinat Pravin made allegation that her husband and other in-laws demanded Rs. One lakh and due to non-fulfilment of demand of dowry, they assaulted her and thrown her out of the house.

Learned counsel for the petitioner submits that prior to lodging of the case, the father of the petitioner lodged Complaint Case No.961 of 2013 on 22.06.2013 against the father of Jinat Pravin and others. The petitioner filed Matrimonial Case No.165 of 2013 on 06.11.2013, in which, notices were issued but

Patna High Court Cr.Misc. No.51961 of 2014 (2) dt.05-01-2015 2/2 the informant did not appear and thereafter filed the present case making false and frivolous allegations.

Perused the record.

Having considered the fact that prior to lodging of the case, the petitioner filed matrimonial suit for restitution of conjugal rights, prayer for anticipatory bail is allowed. The petitioner, above named, in the event of his arrest or surrender before the Court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Sitamarhi in connection with Sitamarhi P.S. Case No.654 of 2014, subject to the conditions laid down under Section 438(2) of the Code of Criminal Procedure. (Prabhat Kumar Jha, J) Pawan/- U T
