The petitioner apprehends his arrest in Sasaram (Model) P.S. Case No. 766 of 2015 registered for the offences punishable under Sections 420, 467, 468, 465, 466, 471 and 120(B) of the Indian Penal Code.
The informant filed the complaint case on the basis of which present FIR was registered. The informant and Gupteshwar Singh are members of the same family. Gupteshwar Singh entered into conspiracy with the petitioner Pramod Kumar Gupta and fraudulently got permission from the Circle Officer and on the basis of which Gupteshwar Singh executed a sale deed with regard to Plot No. 8, 18, 19 and 20 of Khata No. 33 and 34, total area
Patna High Court Cr.Misc. No.16165 of 2017 (2) dt.24-04-2017 2/2 97.75 decimals. The informant alleged that he also got share in that land but Gupteshwar Singh impersonated one Girija Prasad Singh and brought the sale deed into existence. Learned counsel for the petitioner submits that the petitioner is a purchaser and he had no knowledge that the complainant also got share in the aforesaid land. The informant has already filed a title suit for setting aside the sale deed.
Considering the facts aforesaid and the fact that the petitioner is a purchaser and he purchased the land from Gupteshwar Singh who happens to be co-sharer of Umashankar Singh, the informant, the petitioner above named, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Rohtas at Sasaram in Sasaram (Model) P.S. Case No. 766 of 2015, Subject to the conditions as laid down under Section 438 (2) of the Code of Criminal Procedure.
