The petitioner is in custody in connection with Forbesganj P.S. Case No. 820 of 2017 for the offence under Sections 363 and 392 of the Indian Penal Code. Learned counsel for the petitioner submits that the petitioner is in custody since 10.11.2018. He further submits that the petitioner was not named in the F.I.R. and in fact the case was registered against unknown. He also submits that the name of the petitioner surfaced in the instant case on the confessional statement of co-accused, namely, Md. Azad Ansari and Naushad Ansari, who have been granted bail by different co-ordinate Benches of this Court vide order dated 22.06.2018 and 26.03.2018 respectively (Annexure-2 Series).

Considering the fact that the petitioner was not named

Patna High Court CR. MISC. No.20673 of 2019(2) dt.03-04-2019 2/2 in the F.I.R. and his name surfaced on the confessional statement of co-accused, who have already been granted bail, the petitioner, named above, is directed to be released on bail on furnishing bail bonds of Rs.10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Araria in connection with Forbesganj P.S.
