JUSTICE MOHIT KUMAR SHAH ORAL ORDER 25-06-2020 The present petition has been taken up for consideration through the mode of Video Conferencing in view of the prevailing situation on account of COVID-19 Pandemic. Heard the learned counsel for the petitioner the learned APP for the State.

The petitioner seeks regular bail in connection with Neemachandpura PS case no. 05 of 2020 instituted for the offences punishable under Section 30(a) of Bihar Prohibition and Excise (Amendment) Act, 2018.

The allegation is regarding recovery of 117.09 liters of illicit liquor from a TATA Magic vehicle. It is alleged that one locked motorcycle belonging to the petitioner was parked nearby.

The learned counsel for the petitioner has submitted

Patna High Court CR. MISC. No.20997 of 2020(2) dt.25-06-2020 2/2 that the petitioner is innocent, has been falsely implicated in the present and is having a clean antecedent. The petitioner is said to be languishing in custody since 25.03.2020. Having regard to the facts and circumstances of the case, considering the submissions of the learned counsel for the parties as also taking into account the fact that illicit liquor has not been recovered either from the motorcycle of the petitioner or from his conscious possession, the abovenamed petitioner is directed to be released on regular bail on furnishing bail bond of Rs. 10,000/- (Rs. Ten thousand) with two sureties of the like amount each to the satisfaction of Special Judge, Excise Act, Civil Court, Begusarai in connection with Neemachandpura PS case no. 05 of 2020.
